SWEEPSTAKES DESCRIPTION: The 2023 MSUFCU Kickoff Kids Sweepstakes (the Sweepstakes) begins on 8/18/23 (12:00 a.m. ET) and ends on 11/15/23 (11:59 p.m. ET) (the Sweepstakes Period). Two (2) winners will be selected for each of the seven (7) Michigan State University (MSU) 2023 home football games to have their child (ages 6-11) participate as a Kickoff Kid at that game.

SPONSOR: Michigan State University Athletics, Jenison Field House, East Lansing, MI 48824.

ADMINISTRATOR: MSU Federal Credit Union, 3777 West Road, East Lansing, MI 48823.

ELIGIBILITY: Sweepstakes open only to legal residents of the State of Michigan who must be eighteen (18) years of age or older and are parents and/or legal guardians of a child between the ages of 6 and 11 at the time of entry. Employees, directors, officers, trustees and agents, and their respective immediate families (spouses and siblings, parents and children and their spouses) and household members of the Michigan State University Athletics Department, its divisions, advertising and promotion agencies (collectively the Sweepstakes Entities) are not eligible. MSUFCU employees, board members, and their families are not eligible to participate. Void where prohibited.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Sweepstakes.

HOW TO ENTER: To enter, eligible parent/legal guardians must complete an Official Entry Form, available during the Sweepstakes Period at http://www.msufcu.org/kickoffkids (the Website) and submit the Official Entry Form as directed prior to 11:59 p.m. ET on 11/15/23. Limit: One (1) entry per person. Multiple entrants are not permitted to share the same email address. In the event more than the stated allowable entries is received from any one person or email address, the first entry processed will be considered the only valid entry received. Any attempt by an entrant to obtain more than the stated number of entries by using multiple or different email addresses or identities will void that entrant's entries and that entrant may be disqualified. In the event of a dispute, entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be required to show proof of being the authorized account holder. Use of any automated system to participate is prohibited and will result in disqualification. FOURTEEN (14) PRIZES (two per Game): Two (2) winners will be selected for each of the following seven (7) Michigan State University 2023 home football games - vs Central Michigan on 9/1/23, vs Richmond on 9/9/23, vs Washington on 9/16/23, vs Maryland on 9/24/23, vs Michigan on 10/21/23, vs Nebraska on 11/4/24, and vs Penn State at Ford Field on 11/24/23 (Game(s)). Each prize consists of two (2) tickets to one (1) Game, one (1) sideline pass (for the child aged 6-11 designated on the selected entry) and one (1) parking permit (the Prize). As a part of the Prize, the designated children will be on the sidelines during the game and will alternate running onto the field after each MSU kickoff to retrieve the kicking tee. The order of participation will be determined by the age of the children - the youngest child participating first. In the event that only one (1) MSU kickoff is performed, no opportunity will be given for the second child at that (or other) games. The approximate retail value of each prize is $100. All games are subject to rescheduling. As ticket holders, all recipients of Prizes are subject to the terms and conditions of MSU football game tickets.

WINNER SELECTION/VERIFICATION: The initial drawing will be conducted on or about 8/25/23. Subsequent random drawings will be conducted on or about five (5) business days prior to the next home Game, per the schedule above. All winners will be selected in random drawings conducted from among all eligible entries received at of the time of the drawing. Entries not selected in any drawing will be retained for subsequent drawings. Winners will be notified by phone and/or email and have two (2) business days to respond to MSUFCU. Failure to respond by the end of the second business day will result in the selection of a new winner(s). During the winner notification phone calls, the selected individual must confirm his/her eligibility, and indicate his/her willingness and ability to travel and be present at Spartan Stadium in East Lansing, MI on the Game date for which he/she was selected or Ford Field in Detroit, MI for the Penn State game on 11/24/23. A selected winner that does not meet the eligibility requirements, cannot be present, or does not wish his/her child to participate in the Kickoff Kid Event will be disqualified, and an alternate winner will be randomly selected and notified as per the procedures outlined above. All winners will be required to complete, execute and return within a specified time a Declaration of Eligibility and Liability/Publicity Release. Winners must sign an MSUFCU release form for MSUFCU to use the winner's name for purposes of advertising and promotion on behalf of MSUFCU without further compensation. If a potential winner fails to timely return the required documents or to show up for the specified Game, the opportunity to participate will be forfeited and no alternate winner will be selected. Winners are not eligible to win more than one Michigan State University Athletics contest or promotion per calendar year. Winners will be randomly selected by MSU Federal Credit Unions Marketing and Internal Audit departments. The odds of winning any drawing depends on the number of eligible entries received for that drawing. Winners will be responsible for all taxes (federal, state, local and/or income) and all expenses not listed (including but not limited to travel to and from the Game) related to acceptance and use of prize. No transfer or substitution of prize permitted, except by Sponsor who reserves the right to substitute prize, in whole or in part, for one of comparable or greater value due to unavailability for any reason, as solely determined by Sponsor.

CONDITIONS / RELEASE: By participating, entrants, on behalf of themselves and their child (a) release Sweepstakes Entities, their respective directors, officers, agents and employees, and Sponsor and its affiliated companies, agencies or marketing partners, from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability. Neither Sweepstakes Entities nor Sponsor or any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website, or any other error or malfunction, or any injury or damage to participant or any other persons computer or movie equipment related to or resulting from participation in this Sweepstakes. By accepting a prize, winner grants to Sponsor, Michigan State University, Sweepstakes Entities and their affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), email address, voice, biographical information, written or oral statements, for advertising and promotional purposes in promoting the Sponsor, its products, website, and/or this Sweepstakes or succeeding Sweepstakes, without compensation unless required by law. Winners shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), email address, biographical information, or entry. For the avoidance of doubt, all rights granted under this paragraph to Sweepstakes Entities shall extend to Sponsor and its affiliated companies, agencies or marketing partners with respect to all entrants in the Sweepstakes, including non-winners and winners. CAUTION: ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE JUDGING OR VOTING PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Sweepstakes is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes which in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination or suspension, notice thereof will be posted at http://www.msufcu.org/specialoffers/kickoffkids and the selection of winners may be made from among all eligible, non-suspect Entries received as of the date of the termination, cancellation or suspension, as Sponsor determines in its sole discretion. Entries not complying with all rules are subject to disqualification.

DISPUTES: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Michigan or the appropriate Michigan State Court located in Clinton County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorney's fees; and (c) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan.
